
The Commission is a statutory body established by the Haryana State Government as per the provisions of The Haryana Electricity Reform Act 1997 and The Electricity Act 2003 (hereinafter referred as Act). This Act provides for the constitution of Haryana Electricity Regulatory Commission; restructuring of the electricity industry; rationalization of the generation, transmission, distribution and supply of electricity. It opens the avenues for participation of private sector entrepreneurs in the electricity industry and taking measures conductive to the development and management of the electricity industry in an efficient, economic and competitive manner. The Commission is a body corporate with perpetual succession and a common seal with power to acquire and hold property, movable and immovable, and entitle to sue and be sued. The head office of the Commission is at Panchkula in Haryana.
The Haryana Electricity Regulatory Commission was set up on 17-08-1998. The Commission is a three-member body with specialised supporting staff, designated to function as an autonomous authority responsible for regulation of the power sector in the state. The first Chairman and one member of the Commission were sworn in on 17th August 1998 and the third member joined on 16th September 1998.
Regarding qualifications of appointment of Chairman and Members of the Commission it has been mentioned in the Electricity Act 2003 that the Chairperson and the Members of the Commission shall be persons of ability, integrity and standing who have adequate knowledge of, and have shown capacity in, dealing with problems relating to engineering, finance, commerce, economics, law or management.
The Commission consists of three Members, including the Chairperson. The State Government on the recommendation of a Selection Committee appoints the Chairperson and Members of the Commission. The State Government, for the purposes of selecting the Members of the State Commission, shall constitute a Selection Committee consisting of –
(a) a person who has been a Judge of the High Court, as Chairperson;
(b) the Chief Secretary of the concerned State, as Member and
(c) the Chairperson of the Central Electricity Authority or the Chairperson of the Central Electricity Regulatory Commission, as Member of the Selection committee.
It has been provided for in the Act that the Selection Committee is not required in case of appointment of a person as the Chairperson who is or has been a Judge of the High Court.

Shri
Rohtash Dahiya was administered the oath of office of Member, Haryana
Electricity Regulatory Commission on 3.1.2009 by Hon’ble Power Minister, Haryana
Shri Randeep Singh Surjewala. Before joining as Member, HERC, Shri Dahiya was
working as Member (Thermal), Central Electricity Authority (Ministry of Power)
and Ex-officio Additional Secretary, Government of India. Shri Rohtash Dahiya
did his B.Sc. Engineering (Electrical) from Punjab Engineering College,
Chandigarh; M.Sc. Engineering (Electrical Power System) from Regional
Engineering College, Kurukshetra and Post Graduate Diploma in Financial
Management from IGNOU. He joined as Assistant Director in the erstwhile Central
Water & power Commission (now Central Electricity Authority) in 1974 through
Combined Engineering Service Examination conducted by UPSC. He worked as
Associate Lecturer in Electrical Department at Regional Engineering College,
Kurukshetra (now NIT Kurukshetra). Shri Dahiya has more than 34 years experience
of working in power sector in the country and made valuable contributions in the
areas of renovation and modernization, progress monitoring and site selection
for thermal power plants in the country. He also worked as Secretary, Central
Electricity Authority from Dec., 2004 to July, 2006. In August, 2006 he took
over as Member (Thermal), CEA and Ex-officio Additional Secretary, Govt. of
India. During the tenure, he overviewed the development of thermal power
generation in the country, monitoring the progress of construction of all
thermal power projects in central, state and private sectors, site selection for
setting up large thermal power projects, development and monitoring of Ultra
Mega Power Projects (UMPPs) and aspects related to thermal technology
development including adoption of supercritical technology in the country.
Under his supervision some of the important tasks that were completed include
Preparation of Operation Norms for thermal power stations for the period 2009-14
required by CERC for notification, Standardization of Technical Specifications
for thermal power plants, Formulation of Technical Standards for construction of
new thermal power plants, Optimum land requirement for thermal power stations,
Start-up of two UMPPs, Tilaiya in Jharkhand and Cheyyur in Tamil Nadu. Shri
Dahiya has also been associated with various power development programmes in the
State of Haryana such as site selection of JV project in Jhajjar, engineering
for Yamuna Nagar & Hisar projects and facilitating R&M programme at Panipat
Thermal Power Station. He had also earlier worked as Executive Engineer at
Panipat Thermal Power Station on depuration to erstwhile HSEB.
Shri
Ram Pal was administered the oath of office of Member, Haryana Electricity
Regulatory Commission on 11.11.2010 by Hon’ble Power Minister, Haryana Shri
Mahender Partap Singh. Shri Ram Pal passed his Matriculation Examination from
D.A.V. Higher Secondary School, Karnal; Pre-Engineering from Government College,
Rohtak (Haryana) and completed B.Sc. Engineering (Electrical) from Punjab
Engineering College, Chandigarh. He was selected as G.T.A. (Graduate Technical
Assistant) in the erstwhile Haryana State Electricity Board in the year 1973.
After successful completion of the training period, he was promoted as Assistant
Engineer in the year 1974. On unbundling of Haryana State Electricity Board in
the year 1998 in two companies, assigned duties in Haryana Vidyut Prasaran Nigam
Limited (HVPNL). Subsequently, when the activity of distribution and retail
supply of power was entrusted to two companies w.e.f. July 1999 assigned duties
in one of the Utilities namely Uttar Haryana Bijli Vitran Nigam Limited (UHBVNL).
He has a working experience of about 34 years in the Power Sector in Haryana and
during this period he held important assignments in different capacities, such
as: Assistant Engineer, Executive Engineer, Chief Engineer and then in the last
as Director/Project, which was a very challenging assignment. During most of the
period of his service-career, he remained posted in Operation Wing dealing in
distribution of supply, maintenance of Sub Stations, transmission lines, revenue
collection, attending to consumers’ grievances and other connected activities.
Also he worked in the Grid Construction-dealing in the construction of 220 KV,
132 KV, 66 KV, and 33 KV, Sub Stations and erection of tower network. He worked
as Chief Engineer/ Material Management, dealing with procurement of inventory,
Chief Engineer/ Planning, Design and Construction, responsible for
implementation of various important projects and schemes and also as Chief
Engineer/ Operation. While working as Director/ Projects, apart from executing
other important tasks viz. execution of Rajiv Gandhi Gramin Vidyut Yojna (RGGVY)
and other important schemes, a lot of Grid Sub Stations were sanctioned, got
constructed and capacity of number of Grid Sub Stations got augmented to lessen
the overloading of the power system. Also, a lot of 11 KV feeders were got
bifurcated to ensure the reliability of power supply with consequent reduction
in the technical losses. Have been taking keen interest and took various
effective steps for curbing power pilferage, reduction in line losses. He made a
presentation in the year 2004 in a Conference of “BEST PRACTICES”, held in
Delhi, adopted by the various Power Distribution Utilities and the State
Electricity Boards for arresting the power pilferage menace/reduction in line
losses to make them viable. The Conference was attended by the Heads of almost
all the Distribution Utilities/ State Electricity Boards in the country. After
superannuation, he worked as Consultant with WAPCOS Limited, a Government of
India undertaking under the Ministry of Water Resources. WAPCOS has mini Ratna
status and undertakes a lot of works in different States in India and many
foreign countries as well.
The Commission is entrusted with the challenging task of establishing credible regulatory body in the state of Haryana. The professional and experienced staff assists the Commission. The Commission organised itself to work through 3 divisions namely Secretariat, Tariff and Technical. The Secretary to the Commission handles all the administration, legal and quasi-judicial activities of the Commission. The Tariff Division is responsible for preparing tariff design and models, to develop fairly strong database and collect other relevant information and documents. This division is to advise the Commission on matters relating to tariff and other economic and Financial Issues pertaining to the Power Sector and establishment of tariff in the Power Sector for the utilities in the Haryana State. The Technical Division is responsible for preparing Transmission and Distribution operating standards, matters relating to issue and regulation of license to the utilities maintaining overall performance standards, preparation of Grid Code and Distribution Code, monitoring of loss reduction plans, load forecast, PPA, resource plan etc.
The Commission has also set up a Consumer Service Cell. Besides redressal of consumer grievances, it also ensures that the licensee provides proper services to consumers regarding supply and consumption of electricity.
The Commission has a lean structure with emphasis on officer oriented work culture. It functions in a modern office environment with state of the art IT facilities.

In accordance with the provisions of section 8 (3) of the Haryana Electricity Reforms Act 1997 the administrative expenses, including salaries, allowances and pensions payable to or in respect of the Members, Secretary, Officers and other employees of the Commission are being charged to the Consolidated Fund of the State.
However, as per provision of the Electricity Act, 2003 there shall be constituted a Fund to be called the State Electricity Regulatory Commission fund and there shall be credited thereto-
(a) any grants and loans made to the Commission by the State Government;
(b) all fees received by the Commission under this Act;
(c) all sums received by the Commission from such other sources as may be decided upon by the State Government.
The Fund shall be applied for meeting –
(a) the salary, allowances and other remuneration of Chairperson, Members, Secretary, officers and other employees of the Commission;
(b) the expenses of the Commission in discharge of its functions; and
(c) the expenses on objects and for purposes authorised by this Act.
The Commission is maintaining proper accounts and other relevant records and preparing annual statement of accounts in the form as prescribed by the State Government in consultation with the Comptroller and Auditor-General of India. The Accounts of the Commission are being audited by the Comptroller and Auditor-General of India on annual basis.
The accounts of the Commission, as certified by the Accountant General (Audit), Haryana on behalf of the Comptroller and Auditor-General of India, together with the audit report thereon are being forwarded annually to the State Government and that Government is causing the same to be laid, as soon as may be after it is received, before the State Legislature.
The Commission has also established a Committee to be known as the State Advisory Committee. As per the Act, the State Advisory Committee consists of not more than twenty-one members to represent the interests of commerce, industry, transport, agriculture, labour, consumers, non-governmental organisations and academic and research bodies in the electricity sector. The Chairperson of the State Commission is the ex-officio Chairperson of the State Advisory Committee and the Members of the State Commission and the Secretary to State Government in charge of the Ministry or Objects of State Advisory Committee Commission and the Secretary to State Government in charge of the Ministry or Department dealing with Consumer Affairs and Public Distribution System is the ex-officio Members of the Committee.
The objects of the State Advisory Committee are to advise the Commission on –
(i) major questions of policy;
(ii) matters relating to quality, continuity and extent of service provided by the licensees;
(iii) compliance by licensees with the conditions and requirements of their licence:
(iv) protection of consumer interest; and
(v) electricity supply a Appropriate Commission.
Energy Partnership Exchange Program
The Haryana Electricity Regulatory Commission (HERC) and Public Utilities Commission of Ohio (PUCO), USA have participated as partners in the India Energy Partnership Program (IEPP). United States Energy Association (USEA) implemented the IEPP in co-operation with U.S. Agency for International Development (USAID), Office of Energy, Environment and Technology. The IEPP was designed for mutual transfer of experiences back and forth between PUCO and HERC in an effective and efficient manner and to foster long-term sustainable relationship between partners.
